The pool safety law in France was given its final decree on 31 December 2003 and will now be enforced.
Summary of Legal Requirements...This law has added to and amended the "Code de la construction et de l'habitation", the building regulations in French law and takes effect as follows: From 1st January 2004 all new swimming pools built must be fitted with a standardised safety device, aimed at preventing drowning. All existing pools at Rental properties have until 1st May 2004 to comply. (Non-rented properties have until 1st January 2006). Failure to comply is punishable by a fine of 45000 euro The official
standards for the range of safety devices that conform were announced in the Journal
Officiel on 20th December 2003.
There are 4 types of Safety Device that have been issued AFNOR NF (final) standards: * Safety
Barriers (Fences) - Final Standard published NF P90-306 * Pool
Alarms - Final Standard published NF P90-307 * Safety
Covers – Final Standard published NF P90-308 * Pool Shelters/ Abris - Final Standard published NF P90-309
These
devices each provide conformity to the law but only if the equipment is used
according to the requirements of the standards. An
extract from the standards states; 'All
the safety devices are considered in the documents to at all times be in a
locked position (for the barriers, covers and shelters) or in normal operating
condition normal (for alarms) in accordance with the instructions of
manufacturer.'
It
is therefore important to choose a safety device that will be the most effective
in providing safety at your property.
